These General Terms and Conditions of Sale govern the commercial relationship between SAS VIF Systems (hereinafter referred to as "Prêt à Pousser") and any person making a purchase on the site (hereinafter referred to as the "Customer"). They apply for the duration of their publication online by pretapousser.fr. Prior to payment, the Customer acknowledges having read the General Terms and Conditions of Sale on the www.pretapousser.fr website. Acceptance of the General Terms and Conditions of Sale by the Customer is evidenced by ticking a box on each order: "I accept the General Terms and Conditions of Sale". These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, unless Prêt à Pousser expressly agrees otherwise in writing beforehand. Prêt à Pousser reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

 

Customer Service

The Products sold by Prêt à Pousser are carefully manufactured and packaged. If, however, they are not working properly, the Customer is invited to contact Prêt à Pousser's After-Sales Service, which will provide recommendations for the correct operation of the Product.

Product

Photographs, films, videos, diagrams or drawings of Prêt à Pousser products are not contractual. The essential characteristics of the products are indicated in their respective descriptions, which are the only contractual source. Prêt à Pousser reserves the right to change the technical composition of products without notice, and to withdraw them from sale. 

 

Availability

Our product and price offers are valid for the duration of their publication, unless otherwise specified.

 

Pre-order

The Customer may pre-order a Product before it goes on sale. Pre-orders are placed in the same way as any other order, but will not be delivered until the month mentioned on the Product description. 

 

Control

To place an order on the www.pretapousser.fr website, you must first create an account, either before placing your order, or during the ordering process, by clicking on "Create an account". Certain information is compulsory and is therefore necessary for the processing of the Customer's order. The Customer undertakes to provide truthful information. Consequently, in the event of an error in the Customer's contact details, www.pretapousser.fr cannot be held responsible for the impossibility of delivering the order. 

The Customer may modify the information provided at any time. The information provided by the Customer when placing an order is binding. The customer can view all his invoices in my account.

 

Placing and validating an order

To build up the basket, the customer selects the desired product quantities, then validates by clicking on the "Add to basket" button. On the basket screen, the customer can modify the quantities at any time, or exit to return to the store. By clicking on the "Proceed to checkout" button, the customer can then validate the delivery and billing addresses. To validate and pay for the order, the customer must click on the "Pay" button. A summary of the order shows the number of products selected, the cost of delivery and the total to be paid. The last screen allows you to enter your bank details. Once the order has been validated by the bank payment service, the Customer receives an order confirmation by e-mail. Pretapousser.fr will inform the Customer by e-mail of any stock shortages that may affect the order. Pretapousser.fr reserves the right to cancel any Customer order in the event of a breach by the Customer of its contractual obligations under this order and / or the previous order. The information provided by the Customer when placing an order is binding: in the event of an error in the recipient's contact details, Prêt à Pousser cannot be held responsible for the impossibility of delivering the product. As Pretapousser.fr is a retail website, Prêt à Pousser reserves the right to refuse orders for identical products in large quantities.

 

Delivery

Delivery is made either by direct handover to the customer, or by notification of availability at a post office in the event of absence.

 

Delivery time

Delivery is made to the address indicated by the Customer when placing the order. Prêt à Pousser undertakes to deliver to the Customer within a maximum of 15 days from the day following that on which the Customer placed the order. All other delivery times are given as an indication only; the times indicated on the site are average times usually observed and correspond to order processing times, to which are added the shipping times of carriers.

 

Late delivery

In the event of late delivery, we advise customers to check the status of their order directly online before contacting us on the carrier's website, using the shipment number if available. We invite the customer to inform us of any delay of at least one week in relation to the average delivery time recorded, to enable us to start an investigation with the carrier (investigation times can vary from one to three weeks). If, during the investigation period, the Product is found, it will be redirected immediately to the address given by the Customer when the order was placed. On the other hand, if the Product is not found at the end of the investigation period, the carrier will consider the parcel lost and Prêt à Pousser will send a replacement Product, at its expense. If the period indicated is exceeded by more than 7 days, except in cases of force majeure (carrier strike, accident -non-exhaustive list-), the Customer may cancel the order and be reimbursed; the Customer must then send Prêt à Pousser a registered letter with acknowledgment of receipt within 60 working days from the scheduled delivery date. By express agreement, in the event of force majeure (as recognized by French jurisprudence), Prêt à Pousser is released from any responsibility for delivery. In all cases, timely delivery can only occur if the Customer is up to date with its obligations to Prêt à Pousser, whatever the cause.

In the event of visible damage to the package, the customer may refuse delivery. In the event of damage in transit, a reasoned complaint must be made to the carrier and Prêt à Pousser within 5 days of delivery. In the event of a dispute, the investigation may take up to 21 working days.

All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference must be sent to Prêt à Pousser within 72 hours of receipt of the parcel, failing which, the right to claim will cease to exist.

 

Withdrawal

In accordance with article L221-18 et seq. of the French Consumer Code, "the consumer has a period of fourteen days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of return and delivery costs". This period runs from receipt of the Product. If the seven-day period expires on a Saturday, Sunday or public holiday, it is extended to the next working day. In the event of retraction, the Customer is asked to contact Prêt à Pousser's customer service department to request a return. The Customer must return the Product in its original packaging, accompanied by all accessories, instructions and documentation, its return slip, customer number and order number, to the following address: Prêt à Pousser - Lumiliite, Le Fort 43800 VOREY. The customer may exercise his right of withdrawal without penalty. In the event of retraction, Prêt à Pousser will reimburse the amount of the Product and shipping costs. Prêt à Pousser will make the refund as soon as possible, and no later than thirty days from the date on which the right of withdrawal was exercised. The refund will be made by the same method as the Customer. We invite the Customer to contact Prêt à Pousser.

Legal warranties

Prêt à Pousser is liable for defects in conformity of the goods to the Contract and hidden defects under the conditions provided for in Articles 1641 to 1649 of the Civil Code and Articles L211-4 et seq. of the Consumer Code. Prêt à Pousser warranties 

If the Product is considered defective by Prêt à Pousser, Prêt à Pousser undertakes to offer a promotional code (valid for 1 year) greater than or equal to the value of the defective product. Delivery charges, if any, are the responsibility of the customer. The promotional code issued by Prêt à Pousser as part of the Garantie Pousse can be combined with current offers, but cannot be combined with other current promotional codes. Please contact Customer Service Warranty limitations. Prêt à Pousser's warranty is limited to the replacement of the product recognized as defective and which has been used in conditions conforming to the product description. The Customer is required to submit photos of the Product in order for Prêt à Pousser to conclude that the Product is defective.

 

Price

The prices indicated on Pretapousser.fr are in euros, inclusive of all taxes and including VAT. The price indicated on the product sheet excludes delivery costs, which are displayed in the basket summary before payment.

Prêt à Pousser reserves the right to modify its prices at any time, it being understood, however, that the price indicated on the day of the order will be the only price applicable to the purchaser. The prices indicated include order processing costs.

If you request delivery outside France, your order may be subject to taxes and customs duties when it reaches its destination.

Payment of these duties and taxes is your responsibility, and we invite you to contact the relevant authorities in your country for further information.

 

Payment

The price invoiced to the Customer is the price indicated on the order confirmation sent by Prêt à Pousser by e-mail. The price of the Products is payable in cash on the day of the order. Payment is made by credit card bearing the CB symbol (Visa, Master card). The order validated by the Customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically cancelled and the Customer will be informed by e-mail.

Payment by credit card is secured via 3D secure. Card data transport security is ensured by 128-bit SSL (Secure Socket Layer) encryption, and the payment page is hosted on a bank server that guarantees the integrity and confidentiality of the data collected.

 

Responsibilities 

Prêt à Pousser shall not be held liable for any consequential damages arising from the purchase of the Product. Prêt à Pousser mushrooms must be consumed cooked. Prêt à Pousser declines all responsibility for the ingestion of mushrooms and plants.

 

Disputes

These General Terms and Conditions are governed by French law. In the event of difficulties in the application of the present Contract, the Customer may, before taking any legal action, seek an amicable solution. It is reminded that the search for an amicable solution does not interrupt the legal warranty periods (conformity and hidden defects). In the absence of an amicable settlement, any dispute shall be submitted to the sole jurisdiction of the Commercial Court of Pontoise.

 

Legal information

Prêt à Pousser is a brand of VIF Systems, a SAS registered with the Lyon Commercial Court under RCS 894 356 062, with capital of €300,000 and head office at 21 Rue Commandant Fuzier 69003 LYON. Its VAT number is FR86894356062. Contractual information is presented in French. All elements of this site (photographs, illustrations, trademarks, logos, icons, etc.) are the exclusive property of Prêt à Pousser. These elements are protected by French laws and international texts relating to the respect of copyrights, trademarks, etc. The fact that this site is online does not imply a license to use the elements it contains, such use being subject to the express prior written consent of the owner of these elements. Any reproduction or representation, even partial, by any means whatsoever, without the prior and express written consent of Prêt à Pousser is prohibited and unlawful. Failure to comply with this prohibition constitutes an infringement that may incur the civil and criminal liability of the infringer. Any use of elements of this site for purposes other than consultation, in particular for public, commercial or humorous purposes, may be subject to legal proceedings in France and abroad.

 

Discretion policy

The personal information collected for the purposes of distance selling is mandatory, as this information is indispensable, in particular :

- The customer's address is useful at the time of the order in order to send the order in a timely manner. The customer's telephone number allows delivery personnel and Prêt à Pousser's Customer Service to contact the customer to follow up on the order,

- The Customer's e-mail address allows Prêt à Pousser to confirm the Customer's orders, to send the invoice, as well as to confirm any answers given over the telephone by Customer Service,

This information is also used to facilitate the Customer's use of the Pretapousser.fr site, avoiding the need for multiple re-entries, and to take full advantage of all the functionalities offered by the site. The Customer's bank details (credit card number, date of validity) are encrypted using the SSL system. They are inaccessible to third parties. In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of personal data relating to customers has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). The Customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the French law of January 6, 1978). Customers must send their request signed and accompanied by a photocopy of an identity document bearing their signature. They must also indicate the address to which the reply should be sent.
